- O abuso de posição dominante no licenciamento de patentes essenciais a normasPublication . Duarte, Filipa Belo Morgado; Cunha, Sofia Oliveira PaisAs preocupações de natureza anticoncorrencial no âmbito do licenciamento de Patentes Essenciais a Normas (PEN) decorrem da característica de essencialidade inerente ao uso de tais patentes para a implementação de uma determinada norma técnica. A decisão jurisprudencial no caso Huawei v. ZTE representa uma mudança paradigmática, ao clarificar o papel do Direito da Concorrência, em particular o disposto no artigo 102.º do Tratado sobre o Funcionamento da União Europeia (TFUE), no contexto do licenciamento de PEN. Desde então, a Comissão Europeia tem empreendido esforços no sentido de regulamentar o processo de negociação do licenciamento destas patentes, considerando o complexo equilíbrio entre proporcionar uma remuneração justa aos titulares de patentes e evitar barreiras à entrada de novos concorrentes no mercado. Esta dissertação expõe os principais desafios, o caminho percorrido desde o caso Huawei v. ZTE e a proposta legislativa já avançada. Num volte-face inesperado, a Comissão Europeia comunicou recentemente a retirada da Proposta de Regulamento relativa a Patentes Essenciais a Normas. Tal decisão é um passo atrás, que reinstala uma incerteza jurídica indesejável e abre portas a condutas anticoncorrenciais.
- Accepting generative artificial intelligence in consulting services : an analysis of success factorsPublication . Herzog, Inessa; Lancastre, FilipaThe present study examines the success factors that influence the acceptance of Generative Artificial Intelligence (GenAI) among business consultants. While numerous research studies have developed and expanded models for general technology acceptance, there are still few studies that address the acceptance of GenAI in specific professional contexts such as the consulting industry. This work fills this research gap by developing a new model to investigate the acceptance factors of GenAI among business consultants. The model is based on established theories such as the Technology Acceptance Model (TAM), the Unified Theory of Acceptance and Use of Technology (UTAUT), and the Task-Technology Fit (TTF) model, which have been combined into a new conceptual framework. For empirical verification, a quantitative study was conducted with 147 business consultants to identify key success factors on the intention to use and acceptance of GenAI. The results show that the fit between technology and tasks (Task-Technology Fit, TTF), the expected performance improvement (Performance Expectancy, PE) and the Behavioural Intention (BI) play a crucial role in the acceptance of GenAI in the business consulting context. The study highlights the need amongst companies for targeted training, practical use cases, and a strategic integration of GenAI into existing workflows to promote sustainable acceptance. The results provide both theoretical and practical implications for consulting firms to support the successful implementation of GenAI
- Adoption of AI tools in software development in Germany : curse or blessing for the SME sector?Publication . Blischke, Robin; Rajsingh, PeterThis study investigated the adoption of Artificial Intelligence (AI) tools in Germany's software development sector, focusing on small and medium-sized enterprises (SMEs). AI technologies are reshaping the industry, presenting opportunities and challenges. Using a mixed-methods approach, including 14 expert interviews and a survey of 262 participants, the research identified key factors affected by AI adoption, such as efficiency gains, code quality, competitive pressure, security risks, organizational readiness, technical debt, and ethical concerns. These factors were identified through a literature review, tested via expert interviews, and validated through a survey, adhering to the principle of triangulation. Currently, AI adoption in German SMEs remains in its infancy, primarily focused on enhancing productivity in routine tasks, with strategic integration still limited. Expert insights highlighted SMEs' agility in deploying off-the-shelf AI tools but noted constraints from limited resources and technical expertise. In contrast, large enterprises (LEs) leverage robust infrastructure and R&D investments for more comprehensive AI integration. While AI tools were viewed as an efficiency innovation, findings indicated their disruptive potential to democratize coding, bridge skill gaps, and drive long-term transformations. However, systemic barriers, including security vulnerabilities, ethical dilemmas, and insufficient organizational readiness, continue to hinder widespread adoption. By integrating dynamic capabilities and innovation theories, this research extrapolated AI’s trajectory from incremental efficiency gains to disruptive innovation, fundamentally altering workflows and competitive dynamics. The study offers actionable recommendations to foster readiness, address ethical and security concerns, and promote targeted upskilling for a transformative future.
- Uma análise do crime de branqueamento : como pode o crime não compensar?Publication . Luís, Bárbara Maria Fragoso; Silva, Germano Maques daA presente dissertação tem por objetivo a análise crítica a vários aspetos do fenómeno do branqueamento. Apesar dos esforços das instâncias nacionais e internacionais, as práticas de dissimulação da origem ilícita das vantagens, que persistem e estão em constante evolução, representam uma das mais graves ameaças à estabilidade do Estado de Direito democrático. Percorrem-se diversas questões cruciais para o entendimento da configuração do crime no ordenamento jurídico português, salientando-se, ao longo de toda a exposição, que é a máxima «o crime não compensa» que deve orientar a luta contra o branqueamento, que é deste indissociável. Conclui-se pela corrente necessidade de persistência e aperfeiçoamento da intervenção legislativa, continuando, mais que nunca, a justificar-se a atuação do Direito Penal.
- Analysis the influence factors of influencer on tourist's cognitive styles loyalty and satisfaction : a case study of MacauPublication . Liu, Xinyu; Duarte, António Alexandre de OliveiraThe study examines the new communication mode of influencers on social medias networks, focusing on the various mechanisms and boundary conditions on social media platforms that impact cognitive style, customer loyalty, and customer satisfaction among Macau tourists. For example, influence communication can effectively attract tourists' interest through short videos, live broadcasts and blogs. These interesting contents and useful topics induce tourists' cognitive styles, such as high-value travel experiences, convenient tips, useful shortcuts, or preferential promotions and discounts, so that tourists are willing to follow, which leads to increased customer loyalty and satisfactory consumption results. The three main influencing factors provides an effective and new theoretical reference for the sustainable development of communication, marketing and advertising. The paper establishes a mediation model based on the three influencing relationships, and Macau tourism as a case study for collect data and measure variables through questionnaire survey. The following conclusions have been reached: 1) The changes in cognitive style exert a significant positive influenced to customer satisfaction; 2) Customer loyalty plays a mediated effective between cognitive style and customer satisfaction, and cognitive style positively influenced customer satisfaction by enhancing customer loyalty; 3) The power of influence’s communication is mediated by the effective between cognitive style, customer loyalty and satisfaction. The influence’s communication plays an adjustment role between cognitive style customer loyalty and satisfaction. The changes of cognitive style are positive affected to the connection between customer loyalty and satisfaction.

Lousada, João Francisco Sousa; Duarte, Rui Manuel PintoA presente dissertação versa a obrigação de não concorrência adjacente aos contratos de aquisição de empresa, por vontade das partes ou imposta por certos valores presentes no ordenamento jurídico português. Assim, o cerne do trabalho consiste na análise dos princípios e valores presentes no nosso ordenamento jurídico que fundamentam a existência desta obrigação, da possibilidade da sua estipulação e ainda de uma possível obrigação tácita. São, igualmente, analisados o seu conteúdo, objeto, dimensão e, por fim, as consequências inerentes ao seu incumprimento.
- Art and design innovation in the luxury hospitality businessPublication . Vermeil, Armand Marie Daniel André; Rajsingh, PeterThis dissertation investigates how innovation in art and design contributes to a competitive edge in the luxury hotel industry. Combining an online survey and semistructured interviews, we analyzed the impact of aesthetics, cultural authenticity and artistic creation on customer experience, brand perception and Willingness-To-Pay a premium price. Quantitative results show that almost 86% of participants considered design and artistic staging to be essential elements in their hotel experience. Moreover, 83% said they were willing to pay a premium for a unique artistic concept or design, underlining the strong correlation between visual innovation and price. Statistical analysis also revealed that integrating local cultural elements, sustainability and storytelling around design increases emotional satisfaction and brand attachment. Interviews with experts confirmed the strategic importance of thoughtful, inimitable design: the creation of immersive spaces and collaboration with renowned architects or artists help to differentiate establishments in an increasingly competitive market. The study also revealed a gap between the current enthusiasm for sustainability and the extent to which it is considered when choosing hotels. While professional players insisted on integrating eco-responsible materials, only 30% of customers deemed this essential. Artistic and design innovation appeared to be a major lever for enriching the customer experience and justifying premium pricing. An authentic cultural approach, combined with meticulous aesthetics, coherent storytelling and premium hotel services and amenities, consolidates exclusivity and customer loyalty in luxury hotels.
- Artificial intelligence : understanding the determinants of adoption and intention to recommend the technology in travel and transportationPublication . Disruptive technologies, including Artificial Intelligence (AI), are being used to develop business, create new opportunities, increase productivity and efficiency, and to meet urgent needs. Notwithstanding the possible advantages that this technology may bring, there is still little research on AI use in the travel and transportation industry. Artificial intelligence is one of the most significant technical advancements of the twenty first century. Its impact on society extends beyond employment and education to healthcare and transportation. AI has the potential to enhance economic growth, revolutionise existing industries, and create new ones. This research attempts to contribute to this understudied field, filling a gap in literature, by putting out a novel, thorough, and as far as we know until now not yet tested theoretical model, designed with the combination of the outcome of a literature meta-analysis with travel experience, and intention to recommend the technology important constructs. A quantitative investigation conducted across multiple countries employed structural equation modelling (SEM) to test the suggested model empirically. The findings imply that user attitude is strongly influenced by performance expectancy, that the intention to use AI is significantly influenced by initial trust and attitude.
- Bem-estar dos colaboradores de respostas sociais dedicadas aos mais velhos : a importância do apoio recebido das chefiasPublication . Lopes, Maria Luísa Viana Ramos; Silva, Catarina Raposo Vieira da; Lopes, Sílvia PereiraCom a existência de necessidades sociais crescentes e com a diminuição das respostas no seio familiar, as organizações de economia social surgem como essenciais na ajuda a pessoas em situações de carência ou vulnerabilidade, sobretudo, e neste caso concreto, a pessoas idosas. É, pois, fundamental que estas organizações se constituam num contexto de qualidade, o que só poderá acontecer com o empenho e formação especifica dos colaboradores e das suas chefias, cujo bem estar contribui para a melhoria dos serviços prestados e para o bem estar geral. Este trabalho teve como objetivo estudar e compreender a relação entre o bem estar das pessoas dentro e fora do trabalho, assim como, investigar se o apoio da chefia contribui para o bem estar dos colaboradores de respostas sociais destinadas aos mais velhos. Esta investigação adotou uma abordagem quantitativa, utilizando um desenho transversal, e amostragem não probabilística. A amostra foi composta por 206 indivíduos, com idade superior a 18 anos e empregado há mais de um ano em respostas sociais dedicadas a pessoas mais velhas. Com este estudo pretendeu se recolher uma amostra a nível nacional e deu se continuidade a um questionário disponibilizado online através da plataforma "Google Forms”, de maneira a recolher dados referentes às variáveis sociodemográficas e os respetivos instrumentos para medir os construtos de apoio da chefia, engagement, burnout e satisfação geral com a vida. Os resultados indicaram que verificasse uma relação positiva e significativa entre a percepção de apoio da chefia e o engagement no trabalho e uma relação negativa e significativa entre a percepção de apoio da chefia e o burnout. Encontrou se uma relação positiva e significativa entre o engagement no trabalho e a satisfação geral com a vida, contudo, a relação entre o burnout e a satisfação geral com a vida não foi significativa. As principais implicações destes resultados serão discutidas.
- Beyond the coffee cup : investigating the effects of breaking functional fixedness on consumer decision-making in social media advertisingPublication . Heseler, Mona; Almeida, Filipa deThis thesis explores the impact of breaking functional fixedness in social media advertisements on consumer engagement, product recall and purchase intention, addressing the research question: how does breaking functional fixedness affect consumer decision-making processes? Using a sample of 147 participants divided into experimental and control groups, the study employed a survey-based experimental design to assess cognitive engagement, recall and purchase intentions using validated scales and mediation analysis. The results show that breaking functional fixedness increases cognitive engagement and product recall, but does not significantly affect purchase intentions. These findings suggest that, while behavioural outcomes may need to be aligned with consumer motivations and preferences, strategies that break functional fixedness can foster deeper engagement. This study contributes to the dual-process theory literature and advertising creativity research, and provides practical insights for the design of innovative advertisements. Future research should explore the interplay between creative strategies, such as breaking functional fixedness, and other factors, such as emotional and motivational drivers, to better understand their role in shaping consumer behaviour.
