- Do acordo de colaboração à sentença premial : contributo para o desenvolvimento de um novo paradigma processual penalPublication . Sousa, Carla Maria Pires de Barros e Pereira; Silva, Germano Marques daO atual sistema penal português prevê um sistema premial de que pode aproveitar o autor de factos jurídico-criminalmente relevantes em caso de colaboração para a descoberta da verdade material. Porém, a legislação processual penal não acompanhou essa evolução, não estando legalmente previsto qualquer expediente de que o colaborador possa lançar mão como garantia de que essa contribuição para a descoberta da verdade será valorada em sede de determinação da medida da pena no âmbito de uma sentença condenatória. Na verdade, o legislador sentiu necessidade de dotar o sistema processual de um sistema que fizesse repercutir na fase de julgamento um eventual contributo colaborativo do arguido. Assim, o art. 283.º, n.º 3 al. c) do CPP (na redação dada pela Lei n.º 94/2021 de 21.12) estabelece que a acusação deve conter, sob pena de nulidade, para além do mais, todos os factos relevantes para uma eventual aplicação do instituto da dispensa de pena ou da atenuação especial da pena. Parece-nos que este sistema é insuficiente já que deixa exclusivamente na mão do acusador a descrição daqueles factos, não tendo o arguido qualquer capacidade decisória quanto àquela matéria. Assim, o CPP deverá ser dotado de um mecanismo premial de consenso a estabelecer entre o arguido (devidamente representado por defensor/mandatário) e o magistrado do Ministério Público por forma a garantir que no inquérito conste a descrição de todos os comportamentos colaborativos por aquele adotados. Tal mecanismo deverá incluir ainda a participação do JIC a quem caberá a homologação. Mais do que apresentar uma concreta proposta no âmbito do direito a constituir, este estudo pretende participar numa discussão que já se encontra em curso de forma a contribuir para a aceitação da ideia de que é necessário implementar garantias processuais penais no âmbito do inquérito de que o arguido possa mais tarde aproveitar na fase de julgam
- Pharma getting high : psychedelics as a novel treatment protocol in contemporary wellness and medicinePublication . Bieber, Marc Vincent; Rajsingh, PeterThis thesis examined psychedelics, a potentially transformative novel phenomenon in the multibillion dollar wellness and health care industry. A review of psychedelic research and relevant management theory informed a mixed-methods design for primary data collection. We triangulated qualitative expert interviews and a quantitative survey with the literature, dividing the market into a clinical track and an intentional track, which were found to have areas of overlap with each other, as well as with spiritual uses. Drivers for adoption of psychedelics included technological and research advances, political and legal shifts, and rising mental health needs. Many participants cited unmet needs and the absence of root-cause treatment protocols as an altruistic reason to promote psychedelics as a viable alternative. In the clinical track, technological convergence was likely to shape delivery models and soften disruption for incumbent neuropharmaceutical and mental-health providers. The intentional track might develop as a decentralized alternative that addresses a segmented share of demand. We found development stage-specific roles for all investor types in the clinical track, and primary reliance on philanthropy in the intentional track. We recommended future work that maps adjacent market segments in detail, measures longitudinal effects of industry external and internal events onto market capitalization, and tracks regulatory dynamics across jurisdictions.
- The fabric of the beauty premium : aesthetical injustice within the fashion industryPublication . Romero, Diego Alejandro Baez; Fioravante, RosaThis thesis investigates how organizations in the fashion industry can counterbalance the beauty premium to mitigate aesthetic injustice. While extensive research has discussed and addressed conventional discriminations like gender, race, or ethnicity, appearance-based inequalities remain underexplored despite their significant impact on workplace opportunities and organizational culture. Drawing on an inductive qualitative research design, relying on a dataset of in-depth semistructured interviews at PUMA SE, the study deploys Braun and Clarke's thematic analysis to analyze the data, complemented with triangulation with PUMA´s Code of Ethics. The findings of the study reveal that appearance influences workplace perceptions through physical traits, clothing, and brand representation, but also through broader factors such as confidence, professionalism, and social skills. While PUMA demonstrates a strong commitment to DEI through their policies, training, reporting platforms, leadership action, appearance-based biases are less explicitly addressed compared to other forms of discrimination. The study identifies organizational challenges that include cultural diversity across a global workforce, departmental variations in aesthetic expectations, and the absence of a DEI-specific team. The participants suggested clearer communication policies, regular unconscious bias training, greater transparency in organizational processes, and the creation of DEI-specific structures. It was also emphasized the importance of expanding the inclusion to cover other areas such as disability and neurodivergence. Overall, this thesis contributes to the body of knowledge on aesthetic injustice by investigating how organizations in the fashion industry can counterbalance the beauty premium to mitigate aesthetic injustice offering practical recommendations for integrating appearance into the future organizational DEI strategies.
- From personal values to inclusive practices : the role of founder identity in driving diversity in German startupsPublication . Dahm, Jana Annalena; Fioravante, RosaIn today’s globalized landscape, effective diversity management to increase and maintain a diverse workforce is a critical challenge, especially for startups. Although existing literature confirmed the importance of leaders’ personal values, beliefs and experiences in shaping their willingness to support D&I practices, how this influence arises remains understudied. Additionally, while most previous research focuses on CEOs in large corporations, this study adds nuance by applying these insights to startup founders operating under unique conditions of uncertainty, limited resources, and informal organizational structures. Drawing on qualitative data from nine semi-structured interviews with German startup founders, the study examines how individual-level factors interact with the structural features of startups to influence D&I engagement. The analysis confirms the relevance of theories such as Social Identity Theory and Intergroup Contact Theory, while expanding them by introducing the concept of privilege awareness as a motivator for inclusive leadership. Furthermore, it refines relational demography theory by showing that the diversity of founders’ networks mediates the impact of informal recruitment. Contrary to assumptions that structural constraints limit diversity efforts, the research demonstrates that founder intentionality often overrides these limitations. Startup- specific characteristics, such as small size and flexibility, can be leveraged to embed inclusive norms early. These insights contribute to D&I, leadership, and entrepreneurship literature by offering a context-specific understanding of inclusive behavior in startups. The study concludes with practical recommendations for embedding inclusion early, emphasizing that founder intent and identity play a pivotal role in shaping organizational culture from the outset.
- Moral boundaries in football sponsorship : evidence from the BundesligaPublication . Fink, Christoph; Cruz, Nuno Moreira daThis study examines the influence of ethically controversial sponsors on fan loyalty in the German Bundesliga. While sponsorship has become a key source of revenue for professional football, partnerships with companies linked to specific industries raise questions about their long-term impact on the relationship between clubs and fans. To investigate this question, a mixed-methods approach was used, combining twelve semi- structured expert interviews with an online survey of 252 Bundesliga fans. This triangulation of perspectives provides both qualitative depth and quantitative evidence of the impact of morally questionable sponsorship activities. The results show that controversial sponsors significantly weaken fans' willingness to continue supporting their club, their emotional attachment, and their stadium attendance. Highly engaged fans are particularly vulnerable. Their deep loyalty does not protect them from disinterest, but rather increases their sensitivity to violations of values. Regression analyses confirm that this subgroup reacts most strongly to perceived discrepancies. Expert assessments also underscore the role of organized fan groups as moral corrective forces that amplify public criticism. For clubs, this means that sponsorship is not just a financial decision, but a strategic choice with implications for reputation and culture. Transparent communication and fan involvement are essential measures for mitigating risks and maintaining long-term loyalty.
- Wealth and risk in the c-suite : to what extent CEO and board net wealth shape risk preferences and firm stability in NorwayPublication . Vortmann, Meik Denis; Sasson, AmirWealth plays a central role in shaping economic behavior, influencing individual risk preferences, savings decisions, investment choices, and strategic actions under uncertainty. This study examines the extent to which personal net wealth affects executive risk aversion and firm risk in for-profit Norwegian firms from 2010 to 2023. Leveraging comprehensive administrative data, the analysis constructs a revealed-preference measure of risk aversion based on portfolio allocations. Fixed-effects panel regressions show that higher CEO net wealth is associated with lower absolute risk aversion. However, firm risk, as measured by the Altman Z=-score, is primarily influenced by CEO wealth directly, rather than being mediated by changes in risk aversion. No moderating effect is found for board net wealth on the relationship between CEO risk aversion and firm risk. Sensitivity analyses reveal that the board's share ownership ratio - defined as the board's median total market value of equity holdings in the employing firm relative to its members' total net wealth - directly reduces firm risk and moderates the effect of CEO net wealth on risk outcomes. The findings contribute to corporate governance research by integrating the concept of wealth into the analysis of risk-taking and oversight dynamics. In the context of principal-agent theory, the results indicate that overlooking personal wealth in governance design may lead to misaligned incentives and reduced oversight effectiveness.
- Estágio curricular na Filmesdamente : uma imersão no mundo da produção cinematográfica portuguesaPublication . Araújo, Hugo Miguel Costa; Neves, Jaime Sérgio de OliveiraEste relatório tem como principal objetivo relatar e analisar o meu percurso decorrido na produtora Filmesdamente, no âmbito do estágio curricular realizado durante seis meses. Durante esse período, tive a oportunidade de desempenhar diversas funções no domínio do audiovisual, abrangendo áreas como assistência de imagem, iluminação e pós-produção de vídeo. Primeiramente, será feita uma contextualização técnica das principais metodologias e abordagens utilizadas nas diferentes vertentes em que estive envolvido ao longo do estágio. De seguida, serão apresentados exemplos concretos da aplicação prática desses conceitos, relacionando-os com os conhecimentos adquiridos tanto no contexto do estágio como ao longo do meu percurso académico. Este relatório pretende, assim, evidenciar a evolução das minhas competências técnicas e pessoais, bem como refletir sobre os desafios, aprendizagens e contributos proporcionados por esta experiência profissional no seio de uma produtora ativa no setor audiovisual.
- Fraude fiscal e tributação : atividade probatória : a declaração de impostoPublication . Miranda, Nádia Filipa Ribeiro; Silva, Germano Marques daA presente dissertação estuda o crime de fraude fiscal, em especial a omissão da entrega da declaração de imposto, e por fim, faz uma breve consideração sobre o crime de abuso de confiança fiscal, na medida em que este se pode relacionar com o tema em análise. Para tal, adota-se uma abordagem que combina a análise doutrinária, legislativa e jurisprudencial, com destaque na apreciação de acórdãos que versam sobre o assunto. O objetivo principal é compreender em que medida é que a falta de entrega de declaração pode consubstanciar o crime de fraude fiscal, nos termos do artigo 103.º n.º1 alínea b) do RGIT. Após a análise dos elemento constitutivos do tipo legal, e tendo em conta os exemplos práticos que foram apresentados, conclui-se que não se afigura possível outro enquadramento jurídico que não a qualificação da conduta como fraude fiscal, quando preenchidos os pressupostos normativos.
- Audiovisual curatorial strategies at Canal 180Publication . Suescun Calero, Norman; Alves, Pedro Miguel BarbosaThis report presents the outcomes of a six months curricular internship at Canal 180, completed during the second year of the Master’s in Cinema at Escola das Artes, Universidade Católica Portuguesa. Its primary goal was to design and implement an editorial and audiovisual curatorship model for a custom film cycle, tailored for both television broadcast and social platforms. Key activities included researching and selecting international films, coordinating with 11 directors, drafting interview scripts, and editing short reels for Instagram and TikTok. The project also revived a previously paused programming segment by introducing agile interview capsules, solidifying a methodology suited to dynamic digital environments. This approach not only advanced the development of curatorial and content production workflows but also yielded valuable insights into alternative modes of film circulation beyond traditional exhibition spaces. The frameworks and templates developed during the internship offer a replicable model for future thematic cycles on Canal 180, reinforcing its mission to promote emerging artists and expand its cultural offerings on television and online.
- Touch as a creative gesture : sensory exploration in audiovisual artistic creationPublication . Pinesi, Chiara; Neves, Sónia Patricia InácioThe internship took place between October 2024 and March 2025 in Milan, in the studio of Laetitia Farellacci, a photographer whose work is deeply rooted in the themes of maternity, newborn, childhood and womanhood. Working closely with her on a daily basis, the student had the opportunity to truly understand and experience Laetitia’s unique, sensorial approach to photography, one that blends technical skill with emotional depth and artistic sensitivity. These themes resonate strongly with the student’s own artistic interests, making the internship not just a professional experience, but also a meaningful space for personal exploration and creative growth. Throughout the internship, the student was involved in a wide variety of professional and creative activities: assisting in photo sessions, preparing and managing equipment and lighting, contributing to post-production processes and maintaining communication with clients. The student was also in charge of producing all backstage video content for photo sessions, workshops, and masterclasses, and collaborated on the creation of content for social media and online promotion. Additionally, she participated actively in Laetitia Farellacci’s workshops and masterclasses, and engaged in daily one-on-one exchanges with the photographer, allowing for continuous learning and feedback. A strong emphasis was placed on the artistic and human aspects of the work, with special attention to the role of touch and presence, both central elements in Laetitia’s methodology. This consistent and immersive experience led the student to develop not only strong technical and organizational skills, but also a deeper understanding of the photographer’s unique and sensorially rich approach. This has sparked a new area of theoretical research focused on the importance of tactile experience in the creation of audiovisual work—an aspect that emerged as crucial during the internship and that connects audiovisual production, physical presence, and artistic sensitivity. The internship provided a meaningful and transformative experience, enriching both the student’s practical knowledge and her ongoing artistic inquiry
