Abstract(s)
A presente dissertação incide sobre os principais problemas aplicativos do regime de trabalho a tempo parcial, procurando identificar tais problemas e analisá-los à luz das soluções previstas no ordenamento jurídico português e, bem assim, do teor da Diretiva 97/81/CE do Conselho, respeitante ao acordo-quadro relativo ao trabalho a tempo parcial. Propomo-nos, assim, a abordar problemas como a alteração unilateral do horário de trabalho, a prestação de trabalho suplementar, o direito a férias, o pagamento do subsídio de alimentação e a admissibilidade da previsão de cláusula de exclusividade no caso dos trabalhadores a tempo parcial, tomando sempre como referência a doutrina e jurisprudência que entendemos como relevante.
This dissertation focuses on the main application problems of the part-time work regime, attempting to identify such problems and analyse them in light of the solutions provided for in the Portuguese legal framework, as well as of the content of Council Directive 97/81/EC concerning the Framework Agreement on part-time work. We therefore propose to address issues such as the unilateral modification of working hours, the provision of overtime work, the right to holidays, the payment of meal allowance and the admissibility of the provision of an exclusivity clause in case of part-time workers, always taking as reference the doctrine and case law deemed relevant.
