O presente estudo versa a qualificação jurídica do vínculo contratual dos motoristas de transporte individual e remunerado de passageiros em veículo descaracterizado. Pretendemos aferir se, com base nos elementos essenciais desta prestação laboral, a mesma é prestada com contornos de autonomia ou subordinação jurídica. Para o efeito, parte-se de uma análise dos problemas levantados e as soluções encontradas no contexto europeu e no ordenamento jurídico português.
The present essay addresses the legal qualification of the contractual relation of drivers of individual and remunerated transportation of passengers in uncharacterized vehicles. We intend, therefore, based on the essential elements of this activity, to assess whether it is provided on the basis of autonomy or legal subordination. To this end, we will provide an analysis of the problems raised and the solutions found in the European context and in the Portuguese legal system.
