Abstract(s)
O presente trabalho debruça-se sobre a temática do castigo de menores, procurando obter uma definição consensual de castigo físico e psíquico. Essa definição e as consequências da aplicação de castigos em menores têm uma importância fundamental para o tratamento jurídico da questão. O trabalho em questão recorre a diferentes ordenamentos jurídicos em busca de soluções e outras perspetivas nesta temática, com o propósito de alcançar uma resposta adequada aos nossos tempos e à sociedade portuguesa. Concluímos com a apresentação e a discussão das várias teorias que defendem a justificação ou exclusão da ilicitude de castigos de menores, as suas vantagens e inconvenientes, e com a nossa posição sobre o problema.
The present paper focuses on the topic of punishment of minors, seeking a minimum consensus regarding the definition of physical and psychological punishment. The definition of these terms and the consequences derived from the application of the punishment bear immeasurable importance for processing this matter. This paper uses various legal systems in an insatiable search of solutions and perspectives on this theme, with the aim of reaching an answer adequate to the times and to the Portuguese society. We conclude with a presentation of theories regarding the justification and exclusion of illegality, followed by their advantages and disadvantages and by our stance on the matter.
