Moreira, IvoneQuando se trata de apreciar a relação entre Burke e Rousseau a posição mais comum é considerar, a partir do pensamento dos dois autores, que eles estão em polos opostos. Apesar das divergências, aquilo que alguns estudiosos, conhecedores quer de um quer de outro autor, afirmam é que a acepção que os interpreta como opostos se baseia numa apreciação superficial e que, se pusermos de parte o preconceito e as aparentes divergências, encontraremos mais pontos de contacto do que esperaríamos encontrar. Este artigo limitar-se-á à análise das diferenças entre os dois autores no que respeita à concepção da natureza do homem na sua relação com a sociedade.

Moreira, IvoneO objectivo do artigo é analisar a concepção de contrato social expressa no An Essay Concerning the True Original Extent, and End of Civil Government, e a concepção que do mesmo tema apresenta Burke nas Reflections on the Revolution in France e no Appeal from the New to the Old Whigs. Seleccionámos um conjunto de pontos que gostaríamos de apresentar, primeiro em Locke e depois em Burke, e que ilustram passos importantes da sua doutrina, estabelecendo a peculiaridade de um face ao outro. a)Definiremos o que é a Sociedade Civil em contraposição com o Estado Natural, as razões que levam ao seu estabelecimento e o que esta significa em termos do desenvolvimento humano; b)Daí partiremos para a análise do estatuto do sujeito na sociedade; c)Concluiremos com a apreciação do poder de contestação do governo por parte dos cidadãos e da comunidade política e a decorrente diferença de estabilidade do pacto social.

Moreira, IvoneThe objective of this paper is to analyze the concept of social contract expressed in the Essay on the True Extent and End of Civil Government (2nd Treaty) and the conception that Burke presents about the same theme in Reflections on the French Revolution and the New Appeal to the Old Whigs. We look at the two authors selecting points about the social contract, establishing the uniqueness of each one face to another, starting by defining what civil society is in opposition to the Natural State, the reasons for its establishment and what this means in terms of human development; the analysis of the status of the subject in society; the peculiarity of Burkean social contract and the consequences that emanate from there to the commitments of the subject to the political society and the appreciation of the power of contestating the government by the citizens and the political community and the different stability of the social pact for each of the authors.
- Suárez en el pensamiento político inglés del siglo dieciocho. El pensamiento político de Burke y la herencia de SuárezPublication . Moreira, IvoneEl propósito de este artículo es mostrar la influencia que tuvo Suárez sobre el pensamiento político Anglicano británico, es decir, sobre Edmund Burke, un importante político Whig del siglo XVIII. Esta influencia es vital para una comprensión profunda de la posición del político británico –nacido en Irlanda– en varias de sus batallas importantes, como la crítica de la Revolución Francesa o la denuncia de Burke de la tiránica administración de la India. El enfoque de Burke del Contrato Social es de vital importancia cuando se trata de comprender su pensamiento político y este documento pretende demostrar su conexión cercana con el pensamiento político de Suárez sobre este tema. Para lograr este objetivo, varios pasajes de Suárez en De Legibus y en el Libro III del Defensio Fidei se han comparado con algunos pasajes cruciales de los escritos políticos de Burke para rastrear la influencia de Suárez en el pensamiento político de Burke.
- Thinking about the law with Edmund BurkePublication . Moreira, IvoneBurke intervened in a very significant way at various moments in the political history of the England of his time. Although being considered by some commentators to be a utilitarian, in fact, it is Burke’s fidelity to the principles of natural law that makes all his political interventions coherent. The aim of this paper is to analyze the subordination of positive law to natural law and original justice in Burke’s thought, and we will achieve that by perusing his works through different periods of his career. In order to better understand his position, we will call to the conversation John Locke, from whom he departs, and Francisco de Vitoria, with whom he shares the notion of a society-dependent human nature. From the prophetic views of Burke and Tocqueville about the future, and as a kind of conclusion, we will question if the reference to natural law makes sense in present times.
