Não é qualquer falta de pagamento pontual da retribuição que legitima a resolução do contrato pelo trabalhador. Inerente à justa causa está a gravidade/seriedade do comportamento do empregador, ao ponto de ser de afirmar que não era exigível àquele a prestação de trabalho por mais tempo. A culpa, que se presume, tem relevância no plano indemnizatório. Pretendendo resolver o contrato, o trabalhador tem trinta dias para o fazer. O conceito de inexigibilidade e o momento a partir do qual se conta este prazo são dois aspetos amplamente discutidos na doutrina e na jurisprudência, tendo o Código do Trabalho de 2009 criado dificuldades acrescidas quanto a este último.
Not every absence of timely payment of remuneration legitimates the contract termination by the worker. Inherent to the due cause is the severity/seriousness of the employer's behavior, to the point that it has to be stated that the employee was not required to work any longer. The fault, which is presumed, has relevance in the compensation frame. Intending to terminate the contract, the worker has thirty days to do so. The concept of unenforceability and the timing from which this period is counted are two aspects widely discussed in doctrine and case law, and the 2009 Labour Code has created further difficulties with regard to the latter.
