Deparamo-nos, ainda nos dias de hoje, com uma longa e consolidada orientação jurisprudencial: a recusa dos tribunais administrativos de se imiscuírem naquilo que qualificam como discricionariedade técnica – salvo erro manifesto de livre apreciação.
No âmbito da figura da discricionariedade técnica é sobre a atividade das juntas médicas que nos debruçaremos, salientando as implicações subjacentes, principalmente para o particular. Este, tendo todo o processo clínico favorável à sua pretensão, depara-se com uma situação de disparidade de valoração face ao parecer das juntas médicas, no procedimento de aposentação e no processo administrativo.
Nowadays, we are still faced with a jurisprudential tendency: the refusal of the administrative courts to interfere in what they qualify as technical discretion - except manifest error of free appreciation. Within the scope of the technical discretion is about the activity of the medical boards that we will address, highlighting the underlying implications, especially for concerned individual. He, having all the clinical process favorable to its claim, is faced with a situation of discrepancy of assessment in sight of the opinion of the medical boards, in the retirement procedure and in the administrative process
