O aumento do número de pessoas idosas relativamente à população total tem-se tornado cada vez mais notório. Este envelhecimento populacional traz consigo inúmeros desafios sociais, sendo o abuso de idosos um deles. Este abuso pode suceder sob diversas formas e em vários contextos. Nesta investigação discorremos sobre o abuso da pessoa de idade no meio institucional, incidindo sobre a responsabilidade penal da pessoa coletiva que assiste o idoso. Após a explanação dos conceitos essenciais, abordamos os modelos de imputação da responsabilidade penal à pessoa coletiva através da análise do quadro normativo vigente. Referimos ainda as condutas e os ilícitos imputáveis a estes entes e, por último, indagamos
acerca da ampliação do âmbito da norma de incriminação.
The increase of the number of older people in relation to the total population has become progressively noticeable. This aging population carries numerous social challenges, with elder abuse being one of them. This abuse can take place in several forms and in many contexts. In this investigation we assess the abuse of the elder person in the institutional setting, focusing on the criminal responsibility of the legal person that assists the elderly. Following the explanation of essential concepts, we approach the criminal responsibility imputation models to the legal person through the analysis of the current legal framework. Moreover, we refer the demeanors and the offenses attributable to these entities and, lastly, we question the enlargement of the scope of the incrimination’s standard.
