Abstract(s)
A presente dissertação tem como objeto a temática dos homicídios “passionais”, fenómeno atual e preocupante, pois provoca anualmente, em Portugal e em todo o mundo, dezenas de mortes de mulheres. Investigámos o enquadramento jurídico-penal destes homicídios (no homicídio simples, qualificado ou privilegiado), bem como a sua relação com o crime de violência doméstica, questionando da presença de uma relação de concurso aparente ou efetivo e da possibilidade de aplicação das penas acessórias ao crime de homicídio, concluindo ainda pela necessidade de uma alteração legal, que clarifique estas questões e, ainda, que torne possível a aplicação de penas acessórias, mesmo no caso em que os homicídios “passionais” não ocorram em concurso com o crime de violência doméstica.
The present dissertation has as its object the theme of “passionate” homicides, a current and worrying phenomenon, since it causes dozens of women deaths annually, in Portugal and throughout the world. We investigated the legal and penal frame of these homicides (in simple, qualified or privileged homicide), as well as their relationship with the crime of domestic violence, questioning the presence of an apparent or effective concourse relationship and the possibility of applying accessory penalties to homicide, concluding that there is a need for a legal amendment that clarifies these issues and that also makes it possible to apply accessory penalties, even in cases where “passionate” homicides do not occur in concourse with the crime of domestic violence.
