A presente dissertação tem como objetivo a reflexão sobre o direito de acesso a documentos nas ações de indemnização relativas a infrações às disposições do direito da concorrência, mais concretamente as alterações introduzidas pela Diretiva 2014/104/UE. De forma a tornar mais percetível todas as questões levantadas pela nova Diretiva, iniciamos o estudo pela definição de PRIVATE ENFORCEMENT e a sua importância para a efetivação do Direito da Concorrência Europeu, realizando de seguida uma análise histórica das decisões proferidas pelo Tribunal de Justiça e recomendações da Comissão Europeia sobre esta temática. Por fim, efetuamos uma análise às disposições da Diretiva 2014/104/UE e da sua transposição para o direito interno Português, concluindo que a mesma é um mecanismo essencial para a sistematização do acesso aos documentos, permitindo a harmonização normativa pelos Estados-Membros. Todavia, não deixa de apresentar certos riscos, tendo em conta que poderá proporcionar uma corrida dos Estados-Membros à instauração de normas internas mais apelativas à persecução destas ações nos seus territórios. Devemos ainda referir que, de forma a evitar tais situações, achamos importante a criação de outras vias de resolução de litígios, que assegurem a compensação total dos lesados, sem ameaçarem o PUBLIC ENFORCEMENT.
The purpose of this dissertation is to reflect on the right of access to documents in damages actions relating to infringements of the competition law provisions, in particular the amendments introduced by Directive 2014/104/EU. In order to make all the issues raised by the new Directive more perceptible, we begin the study by defining PRIVATE ENFORCEMENT and its importance for the realization of European Competition Law. Thereafter, we provide historical analysis of the decisions of the Court of Justice and recommendations of the European Commission on this subject. Finally, we analyze the provisions of Directive 2014/104/EU and its transposition into Portuguese national law, concluding that the Directive is an essential mechanism for systematizing access to documents, allowing the harmonization of the legislation in the Member States. However, it presents certain risks, considering that it can lead to a rush by the Member States to introduce internal rules more attractive to the pursuit of such actions in their territories. We must also note that, in order to avoid such situations, we believe that it’s important to create other ways of settling disputes, to ensure the total compensation of the injured, without threatening PUBLIC ENFORCEMENT.
