Em caso de incumprimento, a hipoteca atribui ao credor a possibilidade de ser pago pelo valor da coisa que onera, com prevalência relativamente aos demais credores. Estando o devedor insolvente, estará com toda a certeza em incumprimento perante o credor hipotecário, o que confere a este último uma posição privilegiada no âmbito de processo de insolvência. O credor será considerado um credor garantido, pelo que, dentro do leque de credores da insolvência pertence aqueles que serão pagos em primeiro lugar. Não obstante a posição de primazia que ocupa, o credor titular de hipoteca poderá não obter a satisfação do seu crédito, uma vez que apenas será pago depois de pagas as dívidas da massa insolvente e depois de pagos os credores titulares de eventuais garantias prevalecentes, como os privilégios imobiliários especiais e o direito de retenção.
In case of default, the mortgage assigns to the mortgagee the possibility of being paid for the value of the thing that charges, with prevalence in relation to other creditors. If the debtor is insolvent, he will be in all likelihood in default to the mortgage lender, which gives the latter a privileged position in insolvency proceedings. The creditor will be considered a secured creditor, so within the range of insolvency creditors he belongs to those who will be paid first. Although the primacy position that occupies, the mortgagee may not obtain the satisfaction of his credit, as it he will only be paid after the payment of the debts of the insolvent mass and after the payment of creditors holding any prevailing guarantees, such as special real estate privileges and right of retention.
