A presente dissertação versa sobre a conciliação entre as obrigações resultantes do contrato de trabalho e os Direitos, Liberdades e Garantias do trabalhador enquanto cidadão e, em sequência, a problemática da relevância da conduta extra laboral e em que termos esta pode consubstanciar despedimento. Feita tal análise, procede-se á distinção entre o regime geral do contrato individual de trabalho e o caso do denominado “trabalhador portador de tendência”.
This essay concerns the conciliation between the obligations resulting from the contract of employment and the Rights, Freedoms and Guarantees of the worker as a citizen and, in sequence, the problem of the relevance of the extra work behavior and in what terms it may constitute dismissal.
