Abstract(s)
Na elaboração do Código Civil, o legislador consignou conceitos abstratos e indeterminados com a virtualidade de abranger uma multiplicidade de situações concretas de responsabilidade civil. Devido a esta opção legislativa, discute-se quais são os pressupostos necessários para que a privação do uso seja subsumível ao conceito indeterminado de dano e, consequentemente, indemnizável. A presente dissertação tem como principal desiderato responder a esta questão através de uma análise jurisprudencial sobre o tema, mais especificamente face a bens imóveis.
In the Portuguese Civil Code, the legislator used abstract and indeterminate concepts in order to regulate a multiplicity of concrete situations of Tort Law. Due to this legislative option, it is discussed which are the necessary requirements for the loss of use to be considered a damage and, consequently, compensable. The main purpose of this dissertation is to answer this question through a jurisprudential analysis of the subject, more specifically in relation to immovable property.
