Abstract(s)
A presente dissertação tem como objetivo explorar as dificuldades na definição e, sobretudo, identificação dos grupos protegidos no âmbito do crime de genocídio, tendo como base a Convenção sobre o Genocídio e seus trabalhos preparatórios, a jurisprudência e a doutrina existentes sobre o assunto. Pretendemos, ainda, perceber se a enumeração dos grupos protegidos se mantém atual.
Para tal, definimos brevemente os grupos enumerados e, a partir do material existente, abordamos algumas questões pertinentes: a abordagem subjetiva e objetiva, os grupos excluídos, a abordagem positiva e negativa e as soluções sugeridas, refletindo criticamente sobre todas elas.
Concluímos que os grupos enumerados se revelam adequados, tendo em conta a especificidade do crime em causa.
The aim of this dissertation is to explore the difficulties regarding the identification and definition of the protected groups against the crime of genocide, relying on the Convention, jurisprudence and literature available on the subject. We also intend to understand if the groups protected continue to make sense, in the present time. We proceeded to briefly define the enumerated groups and, using the existing material, we came across some pertinent points: the subjective and objective approach, the excluded groups, the negative and positive approach and the suggested solutions, all of which we analysed critically. We concluded that the enumerated groups stand to be appropriate, given the specificity of this crime.
