Abstract(s)
A presente dissertação destina-se ao estudo do crime de homicídio privilegiado, previsto e punido pelo art.133.º do CP. O homicídio privilegiado é menos punido do que o homicídio simples devido à menor culpa do agente ligada aos motivos que determinaram a sua concretização. O autor do facto só beneficiará do regime do art.133.º do CP se tiver atuado sob a influência de circunstâncias emotivas fortes e desculpáveis. O agente é dominado por determinados estados de afeto (compreensível emoção violenta, compaixão, desespero ou motivo de relevante valor social ou moral) que influenciam o seu discernimento e a sua forma de agir. São estes estados de afeto que condicionam a conduta do agente e que o colocam numa situação de exigibilidade diminuída. Por último, dedicamos particular atenção à relevância prática do quarto elemento privilegiador (motivo de relevante valor social ou moral). A evolução e o desenvolvimento da sociedade portuguesa nas últimas décadas, permite-nos concluir que a invocação deste elemento privilegiador no atual Direito Penal português é residual.
This dissertation is intended for the study of the crime of manslaughter, foreseen and punished by article 133.º of the Penal Code. Manslaughter is less punished than the crime of murder due to lesser guilt of the agent linked to the reasons that will determine the substantiation of the crime. The agent of the fact will only benefit from the regime of article 133.º of the Penal Code if he acts under the influence of strong and excusable circumstances. The agent is dominated by certain states of affection (understandable violent emotion, compassion, despair or motive of relevant social or moral value) that influence his discernment and his actions. There are the states of affection that condition the behaviour of the agent and that place him in a situation of diminished enforceability. Finally, we dedicate particular attention to the practical relevance of the fourth privileged element (motive of relevant social or moral value). The evolution and development of the Portuguese society in recent decades, allows us to conclude that the citation of this privileging element in Portuguese Criminal Law is residual.
