Abstract(s)
O presente trabalho debruça-se sobre a locação financeira restitutiva. A locação financeira restitutiva surgiu nos Estados Unidos da América, mas rapidamente se difundiu por toda a Europa. Em primeiro lugar, torna-se imprescindível proceder à definição de locação financeira restitutiva e analisar a admissibilidade da locação financeira restitutiva no nosso ordenamento jurídico. Posteriormente, estudamos a proibição do pacto comissório, prevista no art. 694º do CC, debruçando-nos sobre os fundamentos deste último e adotando uma posição acerca desta questão. Apreciamos a compatibilidade da locação financeira restitutiva com o princípio subjacente à proibição prevista no art. 694.º CC. Analisamos, também, a admissibilidade do pacto marciano. Por fim, ainda expomos que a locação financeira restitutiva não se deve confundir com outras figuras afins demonstrando as diferenças relativamente à locação financeira restitutiva.
This work focuses on the sale and lease-back. Sale and lease-back emerged in the United States of America, but quickly disseminated all over Europe. First of all, it is essential to define sale and lease-back and we described the admissibility of sale and lease-back in our legal system. Subsequently, we studied the prohibition of the comission pact present in art. 694º CC, addressing every fundament of this agreement and adopting a position regarding this question. We have examinated the compatibility or incompatibility of the sale and lease-back with the principle underlying the prohibition in art. 694º CC. Then, we studied the admissibility of the marciano pact. Finally, we also expose that the sale and lease-back should not be confused with other related figures.
