Da definição de Refugiado da Convenção de 1951 e do Protocolo de 1967, resultam conceitos indeterminados, dos quais o Receio Bem Fundamentado assume especial importância. Aferir a ratio da figura e as considerações que o UNHCR faz acerca da mesma, são o ponto de partida para o nosso estudo. Analisar as abordagens tomadas pelas entidades decisoras no tratamento da figura e confrontá-las com os estipulados convencionados, de forma a compreender as implicações que o “receio” e o seu “bom fundamento” têm na determinação do estatuto de refugiado, revela-se fundamental. Questionar as nuances do regime no que toca aos pedidos baseados na orientação sexual, é o objetivo principal.
The definition of refugee from the 1951 Convention and the 1967 Protocol come from undetermined concepts, from which the well-founded fear assumes particular importance. Determining the ratio of the figure and the considerations that UNHCR makes about it are the starting point of our study. Analyzing the approaches taken by the decision makers in the treatment of the figure and confronting it with the Convention to understand the implications that “fear” and “well-founded” have in the determination of the refugee status, reveals itself fundamental. Questioning the nuances of the regime when it comes to applications based on sexual orientation is the main goal.
