Abstract(s)
A presente Dissertação é elaborada no âmbito do Mestrado em Direito, com área de especialização em Direito Criminal, onde pretendemos dar a conhecer detalhadamente a figura das declarações do arguido, nomeadamente a sua utilização em audiência de julgamento, quando prestadas em fase anterior à mesma, analisando os possíveis problemas que podem surgir com a sua leitura e/ou reprodução. Segue-se a exposição dos temas supra mencionados em que se pretende analisar as declarações do arguido, a sua natureza e a problemática que pode surgir com a sua utilização em sede de audiência de julgamento. Deste modo, cremos que a Dissertação possa contribuir para uma melhor compreensão da matéria supra referida, questões estas que são importantes para um bom funcionamento do ordenamento jurídico, para tal, oferecendo uma visão ampla, quer doutrinal, quer jurisprudencial.
The present dissertation is elaborated within the scope of the Master´s Degree in Law, with a specialization area in Criminal Law where we intend to give a detailed description of the defendant's statements, namely their use in a trial hearing, when rendered before the same, analyzing the problems that may arise with your reading and / or playback. The following is an exposition of the aforementioned themes in which it is intended to analyze the statements of the accused, their nature and the problems that may arise with their use in the hearing of the trial. In this way, we believe that the Dissertation can contribute to a better understanding of the aforementioned matter, issues that are important for a good functioning of the legal system, for this, offering a broad vision, both doctrinal and jurisprudential.
