Nas últimas décadas, o mundo do trabalho sofreu profundas alterações desencadeadas pela proliferação das NTIC. A prestação de trabalho deixou de estar diretamente relacionada com a empresa ou estabelecimento profissional, passando a ser possível trabalhar a partir de qualquer lugar, a qualquer hora. Esta aparente flexibilidade e a conceção de que o trabalhador deve estar sempre ligado, trouxe consigo várias problemáticas relacionadas com a ultrapassagem das regras relativas aos tempos de trabalho, nascendo, assim, a discussão em torno do direito à desconexão. Temática que, pela sua premência e atualidade, é debatida por empresas, organizações internacionais e, não raras vezes, legislada por vários ordenamentos jurídicos.
In the past few decades, the employment world has undergone profound changes triggered by the proliferation of NICTs. The provision of work is no longer directly related to the company or professional establishment, and it is now possible to work from anywhere, anytime. This apparent flexibility and the idea that the worker should always be connected has brought about several problems related to the exceeding of the rules regarding working times, thus giving rise to the discussion about the right to disconnection. A theme that, due to its urgency and topicality, is debated by companies, international organizations, and often legislated by several legal systems.
