Abstract(s)
Este trabalho visa iluminar o conceito de royalty. Partiremos da matriz oferecida pela convenção-modelo da OCDE (Organização para a Cooperação e Desenvolvimento Económico). Salientaremos também, sempre que necessário, os congéneres modelos para uma abordagem holística a esta temática. Como veremos, estando esta temática relacionada com os contratos de transferência de tecnologia, não se dispensará um olhar atento sobre os contratos de know-how, contratos de assistência técnica e contratos de prestação de serviços técnicos. Por motivos didáticos, e tendo em conta que na convenção-modelo da OCDE, o artigo 12 relativo a royalties compreende quatro parágrafos, decidimos seccionar o nosso trabalho de acordo com os mencionados parágrafos.
This thesis aims to explore the concept of royalty trough the framework of the OECD model convention. We’ll highlight, whenever needed, its model counterparts for a holistic approach to this issue. As we’ll see, this subject establishes a close relationship with the broader topic of technology transfers, and as such we must underline the know-how, technical assistance and technical services contracts. For didactic purposes and considering article 12 of the OECD model that concerns royalties is divided in four paragraphs, we divided this thesis accordingly.
