Abstract(s)
A dissertação de mestrado que ora se apresenta tem o propósito de
evidenciar a inoperabilidade do instituto do período experimental em sede de
laboração desportiva. Para esse efeito elencam-se argumentos que procuram
demonstrar, por um lado, a frágil adequação da aposição desta figura jurídica aos
contratos de trabalho desportivos e, por outro, a sua instrumentalização pelas
entidades empregadoras. É desta equação que resulta a defesa pela supressão de
tal instituto do regime jurídico do contrato de trabalho desportivo.
Nesta reflexão crítica procura-se não perder de vista a realidade desportiva,
pois é com base nela e para ela que deve se nortear a lei do trabalho desportivo.
The present master dissertation has the purpose of showing the inoperability of the institute of the probationary period in the context of sports work. For this purpose, arguments were put forward to demonstrate, on the one hand, the fragile adequacy of the affixing of this legal figure to sports work contracts and, on the other hand, its instrumentalization by the employers. It is from this equation that results the defence for the suppression of such institute of the legal regime of the contract of sport work. In this critical reflection it is sought not to lose sight of the sporting reality, because it is based on her and for her that should be guided the law of sports work.
