As causas de suspensão da prescrição surgem como um paliativo ao efeito da prescrição, nesse sentido dedicamo-nos ao seu estudo e crítica histórica, legislativa e a nível de direito comparado, mormente com as legislações que mais influenciam o nosso ordenamento jurídico – a Alemã no código civil alemão e a Italiana no Codice Civile. No fim do estudo hipotetizamos uma alteração legislativa quer a nível de alteração às causas já existentes ou perante um eventual acréscimo legislativo face a recentes mudanças legais na legislação alemã.
The causes of suspension of the statute of limitations appear as a softening to the effect of the statute of limitations, in this sense we dedicate ourselves to its study in a historical, legislative and comparative law fashion, especially with the legislations that most influence our legal system - the German in the German civil code and the Italian Codice Civile. At the end of the study we hypothesized a legislative change either in terms of changing existing causes or in the event of a possible legislative increase in the light of recent legislative innovations in German law.
