Abstract(s)
Neste trabalho, procurou-se esclarecer aspetos fulcrais do tratamento jurídico
da atividade prostitucional no ordenamento jurídico português, especificamente a
validade dos contratos integrados na atividade prostitucional e o âmbito objetivo do
crime de lenocínio.
Para isso, procedeu-se à caraterização desses contratos e à análise dos parâmetros de
licitude do negócio jurídico que lhe são aplicáveis, articulada com a especificação dos
atos jurídicos subsumíveis ao crime de lenocínio e a tentativa de compreender o
significado jurídico específico desta incriminação.
This paper aims at clarifying central aspects of prostitution’s legal treatment in the Portuguese legal system, specifically the validity of the contracts integrated in prostitution and the objective scope of the crime of incitement to prostitution (article 169 of the Portuguese Penal Code). For this purpose, the characterization of these contracts was undertaken, as well as an analysis of the appliable legality parameters for such juridic acts, articulated with the specification of the juridic acts falling within the article 169 and the attempt of understanding this crime’s specific legal meaning.
