A presente dissertação de mestrado tem como objetivo analisar o artigo 144.º-A do Código Penal, que veio introduzir o crime de mutilação genital feminina no ordenamento jurídico português. Após um sucinto enquadramento do tema, faremos o tratamento penal deste novo crime e analisaremos as particularidades do seu regime. Faremos ainda uma reflexão crítica e fundamentada sobre todos os aspetos controversos que rodeiam o crime, designadamente a sua autonomização e a sua localização sistemática. Finalmente, apresentaremos as nossas conclusões e sugestões, esperando que estas contribuam para o debate e aperfeiçoamento do regime legal deste novo crime.
The object of this master’s dissertation is the analysis of article 144-A of the Criminal Law, which introduced the female genital mutilation crime in the Portuguese legal system. After a short contextualization of the theme, we will present the legal treatment of this crime and analyze the details of its regime. There will also be a critical and founded reflection on all controversial aspects concerning this crime, namely its autonomization and its systematic location. Finally, we will present our conclusions and suggestions, hoping they may contribute to the debate and improvement of the legal regime of this new crime.
