O contrato de trabalho doméstico é um contrato de trabalho especial regulado pelo Decreto-Lei n.º 235/92, de 24 de outubro. Apesar da recente reforma deste diploma várias questões ficaram por resolver, principalmente na cessação do contrato de trabalho doméstico pelo empregador com justa causa e a (não) existência de procedimento disciplinar, em que, no nosso entendimento, se nota a maior desproteção destes trabalhadores, podendo-se até falar em discriminação. Neste sentido, o objetivo da presente dissertação é analisar criticamente as recentes alterações nesta matéria e o regime atual, e verificar se as razões que motivaram este regime realmente justificam tamanha desproteção dos trabalhadores domésticos e quais as soluções a ser adotadas.
The domestic employment contract is a special type of employment contract governed by Decree-Law No. 235/92 of October 24. Despite the recent reform of this decree, several issues remain unresolved, especially regarding the termination of the domestic employment contract by the employer for just cause and the absence of a disciplinary procedure, in which, in our understanding, there is a notable lack of protection for these workers, which could even be considered discriminatory. In this context, the aim of this dissertation is to critically analyze the recent changes in this area and the current regime, and to assess whether the reasons that motivated this regime truly justify such a lack of protection for domestic workers and what solutions should be adopted.
