Abstract(s)
A presente dissertação visa analisar as alterações verificadas no regime jurídico do Processo Especial de Revitalização, em concreto no que diz respeito aos efeitos processuais decorrentes do despacho de nomeação do administrador judicial provisório, previstos no artigo 17.º-E do Código da Insolvência e da Recuperação de Empresas, em especial no n.º 1 do mencionado preceito. Assim, e na medida em que a alteração legislativa não clarifica todas as questões que a redação anterior suscitava, trazendo, inclusivamente, novas problemáticas para a discussão doutrinária e jurisprudencial no nosso ordenamento jurídico, propomo-nos a estudar a presente temática e procurar tomar posição quanto às diversas demandas.
This dissertation aims at analyzing the changes that have taken place in the legal framework of the Special Revitalization Process, specifically regarding the procedural effects of the order appointing the provisional judicial administrator, provided for in Article 17-E of the Insolvency and Corporate Recovery Code, in particular paragraph 1 of the aforementioned provision. Therefore, and to the extent that the legislative change does not clarify all the issues that the previous wording raised, even bringing new issues to the doctrinal and jurisprudential discussion in our legal system, we propose to study this topic and seek to take a position regarding the various demands.
