O ingresso no património coletivo dos cônjuges de uma quota adquirida por apenas um dos consortes pode suscitar um grave conflito entre o interesse social que é prosseguido pela sociedade e o interesse de cada um dos cônjuges naquele património, regulado pelo estatuto patrimonial do casamento. Este estudo pretende compreender qual a posição jurídica do cônjuge meeiro daquele que, segundo o Direito societário, é considerado como sócio, e como poderá exercer os correspondentes direitos, dando especial relevância ao direito à informação que se afigura como fundamental para a respetiva tutela.
The entry of a share acquired by only one of the consorts into the marital assets can give rise to a serious conflict between the social interest that is pursued by the company and the personal interest of each spouse on those assets, regulated by the patrimonial status of marriage. This study aims to analyze the legal position of the spouse of a Company’s shareholder, in particular his ability to exercise the membership rights. We will focus on the right to information, which is fundamental to achieve his protection.
