Abstract(s)
Atualmente, graças à crescente proliferação dos riscos psicossociais, o mundo do
trabalho enfrenta novos desafios. Os trabalhadores encontram
-
se sujeitos a diversos
riscos, nomeadamente, stress, assédio moral ou
mobbing
,
burnout
e
violência.
E as repercuss
ões são visíveis, manifestando
-
se não apenas na quebra de
produtividade dos trabalhadores (com prejuízos evidentes para a empresa), mas também
no aumento de patologias do foro psíquico (com o
s
dano
s
social e económico que
acarretam).
Infelizmente, deste c
enário podem resultar consequências dramáticas para os
trabalhadores, sendo a mais gravosa de todas o recurso ao suicídio.
O presente trabalho opera uma análise comparativa entre os ordenamentos
espanhol, francês e português, analisando as respostas que o
ferecem a este problema.
Ora, os ordenamentos espanhol e francês têm admitido (ainda que sob
determinadas circunstâncias) a possibilidade de
o
suicídio se reconduzir à figura do
acidente
de trabalho, ao estabelecer
-
se um
nexo de causalidade entre o suicíd
io e as
circunstâncias em que o trabalhador realizava a sua prestação laboral.
Todavia, no ordenamento nacional, a jurisprudência não tem ido neste sentido.
Pelo contrário, há uma grande dificuldade em admitir que um suicídio possa consistir
num acidente d
e trabalho.
Ora, pretendemos através deste estudo demonstrar a necessidade de se trilharem
novos caminhos e de se encontrarem soluções que ultrapassem este problema, sobretudo
no seio do ordenamento nacional, em particular
pelo avolumar dos
riscos que pode
m
contribuir para a verificação deste género de situações e as gravosas consequências individuais, sociais e económicas que daqui advêm.
Nowadays, due to the increasing proliferation of psychosocial risks, the world of work faces new challenges. Workers are subject ed to various risks, namely stress, bullying, mobbing, burnout , and violence. This scenario has led to dire consequences, not only to companies (due to absenteeism and a decrease in productivity), but also to individuals and society in general (with the increase of health problems and their social implications). Unfortunately, some times employees resort to extreme measures, such as suicide, as an answer to this situation. This work will provide a comparative analysis between the Spanish, the French , and Portugues e regimes , in order to try and convey their solutions to this issue. The Spanish and the French legal systems have shown concern towards these events, admitting (although under certain circumstances) the possibility of considering suicides as an accident at work, establishing a causal link between that event and the circums tances under which the work was being provided. However, the Portuguese jurisprudence does not share this view. In short, we will try and demonstrate the need for a new path and new solutions to overcome this problem, especially within the Portuguese reg ime , due to the increasing risks may conduct to these situations and their onerous consequences at an individual, a social, and an economic level.
