A utilização generalizada das NTIC vem servindo de pretexto e argumento para o empregador prolongar o seu poder de direção para além dos limites da duração da jornada laboral, o que defrauda os objetivos legais da limitação do tempo de trabalho e aniquila os períodos de descanso necessários, atentando contra a saúde e segurança dos trabalhadores. É de questionar se a necessidade de abolir tais práticas – diga-se, de quase escravidão – legítima uma mudança no ordenamento jurídico laboral? Constatando-se uma resposta positiva, é de analisar se essa mudança se deve concretizar através da consagração de um “direito à desconexão do trabalhador” ou de um “dever de não conexão da entidade empregadora”.
