Abstract(s)
A presente dissertação incide sobre a concorrência desleal, encarada como instituto gerador de concorrência justa. Serão analisados alguns sistemas nacionais, por forma a demonstrar as possíveis configurações dadas ao instituto. Segue-se o estudo dos pressupostos de aplicação da concorrência desleal no ordenamento português, em particular, no que aos denominados atos de agressão diz respeito. Por último, examinamos a regulação europeia naquela que é o seu atual estado, traçando uma proposta para um eventual futuro da matéria.
The present dissertation focuses on unfair competition, seen as a generator of fair competition. Some national systems will be analyzed, in order to determine the possible configurations given to the institute. Then, the study of the conditions of application of unfair competition in the Portuguese legal system, in particular, with regard to the socalled acts of aggression. Finally, we examine European regulation in its current state, outlining a proposal for a possible future of the subject.
