Abstract(s)
A presente dissertação debruçar-se-á sobre a licença parental complementar, mais concretamente, em torno da sua configuração legal no ordenamento jurídico português, o qual será analisado em justaposição com o direito da União Europeia. Fruto do parco desenvolvimento legislativo e doutrinal sobre a licença em apreço, vários são os problemas levantados em torno da sua (correta) aplicação. Assim, procuraremos, no correr do presente trabalho, depois de analisada a sua origem e evolução, explanar o seu regime jurídico, por modo a equacionar e entender esses possíveis problemas, os quais podem, inclusive, evidenciar a falta de conformidade de Portugal com as orientações europeias a que está adstrito nesta matéria.
The present dissertation will pore over parental leave, more specifically, around its legal configuration in the Portuguese legal system, which will be analysed in juxtaposition with European Union law. Borne of the poor legislative and doctrinal development about the leave in appreciation, many are the problems raised around its (accurate) application. Thus, we will seek, in the course of the present work, after having analysed its origin and evolution, explain the legal regime, in order to equate and understand those potential problems, which, can, inclusive, show Portugal’s lack of conformity with European guidelines to which it is attached in this matter.
