Abstract(s)
A evolução tecnológica a que temos assistido nas últimas décadas tem trazido consigo inúmeros desafios para o mundo jurídico. De facto, a implementação cada vez mais frequente de dispositivos dotados de IA no quotidiano do ser humano faz surgir na sociedade uma preocupação crescente quanto aos seus desafios e riscos. Ora, a necessidade de fazer face a estes novos problemas, despoletou quer a nível internacional, quer a nível interno, inúmeras questões relacionadas com a capacidade de autoaprendizagem e autonomia que estes “agentes” evidenciam e que, naturalmente, se repercutem no âmbito da responsabilidade civil, quando da sua utilização resultem danos. Saliente-se que uma das áreas do saber em que a IA se tem imiscuindo é a área da saúde, o que faz com se reacenda a discussão relativa ao modo e em que termos se pode responsabilizar o profissional de saúde quando este se auxilia destes “agentes” na execução dos atos médicos. Desta forma, a presente dissertação aborda questões como a responsabilidade civil dos médicos por atos por si praticados, a responsabilidade dos agentes autónomos e possível criação de uma personalidade jurídica própria, e, por fim, a (im)possibilidade de nos socorrermos às soluções vigentes no Direito Constituído para solucionar estes novos desafios jurídicos.
The technological evolution we have witnessed in recent decades has brought with it numerous challenges for the legal world. In fact, the increasingly frequent implementation of AI-equipped devices in the daily life of human beings has given rise to a growing concern in society regarding its challenges and risks. The need to face these new problems has triggered, both internationally and internally, numerous questions related to the capacity for self-learning and autonomy that these "agents" show and that, naturally, have repercussions on the scope of civil liability when their use results in damages. Note that one of the areas of knowledge in which AI has become involved is the area of health, which rekindles the discussion about how and under what terms the health professional can be held responsible when he or she uses these "agents" in the performance of medical acts. In this way, the present dissertation approaches questions such as the civil responsibility of doctors for acts performed by themselves, the responsibility of autonomous agents and the possible creation of their own legal personality, and, finally, the (im)possibility of resorting to the solutions existing in Constitutional Law to solve these new legal challenges.
