Atualmente, assiste-se a um mundo económico movido pela forte competitividade entre organizações económicas. No seu seio, o trabalhador, enquanto elemento indispensável, sobrevive na relação laboral suscetível às diferentes pressões patronais. O seu principal receio reside na instabilidade do seu vínculo, pelo valor que este representa para sua sobrevivência.
A presente dissertação visa ilustrar a instabilidade dos vínculos laborais, analisando uma decisão jurisprudencial que admite a transformação de um contrato de trabalho a tempo indeterminado num contrato a termo. Para o efeito, atendemos à lógica do Direito Laboral, para melhor analisar a argumentação jurisprudencial em questão, recaindo sobre a forma como o regime jurídico do contrato a termo é contemplado e interpretado no sistema jurídico português. Assim, dentro dos limites formais de redação da presente dissertação, pretendemos debater a admissibilidade deste fenómeno na ordem jurídica laboral.
Nowadays, the economic world is driven by a strong competitiveness between economic organizations. Within it, the worker, as an essential feature, survives in the labor-relation under the pressures conducted by employers. The worker´s main fear lies in the instability of their labor link, for the value which represents to his survival. The present thesis aims to illustrate the instability of labor-relations, analyzing a judgment which allows the transformation of an employment contract in a fixed-term contract. Therefore, to better analyze the court`s position in question, the employment´s law reasoning is going to be attended, concerning how the Portuguese legal system considers and interprets the fixed-term contracts. So, with in the formal writing rules of the following thesis, is intended to argue the eligibility of this incident in the labor’s legal order.
