Abstract(s)
A presente dissertação tem como objetivo fundamental o estudo do crime tráfico de pessoas no contexto internacional. Para a compreensão do referido, iremos começar por uma análise dos instrumentos jurídicos que existem para a prevenção e combate ao referido ilícito. Devido ao facto de o tráfico de pessoas ser considerado violação de uma norma imperativa de direito internacional, também nos iremos debruçar, brevemente, sobre o estudo de normas jus cogens e dos seus efeitos. Por último, a referência à Convenção Europeia dos Direitos do Homem e ao Tribunal Europeu dos Direitos do Homem, e às obrigações positivas para os Estados que podem emergir destes instrumentos. Por ser dos principais órgãos no combate a este flagelo, a parte final da investigação passará pela análise de um dos casos que teve maior importância neste tema. O caso Rantsev vs. Chipre e Rússia foi um ponto de viragem nesta matéria, devido à aplicação do artigo 4º da Convenção ao crime do tráfico de pessoas, a qual suscitou obrigações para cada um dos Estados envolvidos, tendo sido os dois condenados pela sua violação.
The main purpose of this dissertation is the study of the crime of trafficking in persons at an international level. For the comprehension of the above mentioned, we will start with the analysis of the legal instruments that exist for the prevention and combat of this crime. Since human trafficking is considered an imperative rule of international law, we also take on a brief study of the jus cogens norms and their effects on the international community. Finally, a reference to the European Convention of Human Rights and the European Court of Human Rights, and of the positive obligations that can emerge of these instruments. As it is one of the main organs combating this hideous crime, the final part of this investigation will lead us to the analysis of one of the cases that had greatest importance in this matter. The Ratsev vs. Cyprus and Russia has it was a turning point in this regard, due to the application of article 4 of the Convention, which provoke positive obligations for both states involved, which culminated in their conviction for the violation of article 4.
