Abstract(s)
O progresso tecnológico alcançado ao longo das últimas décadas tem cativado a atenção dos Estados e dos seus exércitos e o reflexo destes avanços no campo militar tem se mostrado um fator preponderante para o estabelecimento de dominância entre as grandes potências militares. Os Sistemas Autónomos de Guerra parecem ser o próximo passo desta revolução tecnológica e a possibilidade de virem, em breve, a ser utilizados nos teatros de guerra, tem forçado a comunidade internacional a levar a cabo uma reinterpretação reflexiva das diversas fontes de Direito Internacional e do seu complexo normativo. Com o propósito de evitar as lacunas jurídicas que podem surgir da comissão de crimes de guerra por meio destes sistemas, a presente dissertação analisará a legalidade destes sistemas à luz do Direito Internacional Humanitário e averiguará da necessidade e viabilidade de uma regulamentação multilateral autónoma.
The technological progress achieved in the last decades has drawn the attention of States and their militaries and the impact of these advances on the military field has shown to be a preponderant factor for the power play between major military powers. Autonomous Weapons Systems appear to be the next step in this technological revolution and the possibility of them being used in theatres of war in the near future has forced the international community to take on a reflexive reinterpretation of the various legal sources of International Law and their legal complex. With the purpose of avoiding the legal gaps that may arise in the commission of war crimes through these systems, this dissertation intends to analyze their legality under International Humanitarian Law and ascertain the need and feasibility of an autonomous multilateral regulation.
