Abstract(s)
A aprovação do regime do maior acompanhado com a publicação da Lei n.º 49/2018, de 14
de agosto, e a revogação dos institutos de interdição e inabilitação introduziram importantes
alterações no Código Civil e no Código de Processo Civil.
O presente estudo propõe um olhar sobre o novo regime do maior acompanhado, dando
maior enfoque ao momento processual em que é realizada a audição do potencial
beneficiário da medida de acompanhamento.
Para tanto, fez-se uma comparação com o regime da audição de crianças nos processos de
promoção e proteção de crianças e jovens em perigo e concluiu-se que, tal como o legislador
assegurou o bem-estar da criança, zelando pela sua segurança e pela sua privacidade,
também no regime do maior acompanhado os direitos fundamentais daquele que é ouvido
pelo juiz deveriam estar acautelados.
Propomos, deste modo, a adotação de regras específicas aquando da audição judicial, com
um olhar mais próximo da realidade do potencial beneficiário da medida de
acompanhamento, numa perspetiva de cidadania inclusiva, garantindo que as suas vontades
sejam ouvidas, resguardando o seu bem-estar e o pleno exercício dos seus direitos.
The approval of the adult accompanied regime by the publication of Law no. 49/2018 of 14th of August and the abrogation of full guardianship and partial guardianship institutes, introduced important changes in Civil Code and Civil Procedure Code. This study proposes a look at the new regime of the adult accompanied, giving greater focus to the procedural moment when the potential beneficiary of the accompanied is heard. For this purpose, a comparison was made with the regime of child hearing in the processes of promotion and protection of children and young people in danger and it was concluded that, just as the legislator ensured the well-being of the child, ensuring their safety and their privacy, also in the regime of the adult accompanied the fundamental rights of those who are heard by the judge should be taken care of. Therefore, we propose the adoption of specific rules during the judicial hearing with a closer look at the reality of the potential beneficiary of the accompanying measure, from an inclusive citizenship perspective ensuring that their wishes are heard, safeguarding their well-being and the full exercise of their rights
