A adoção massiva do teletrabalho como meio de prevenção do contágio pela Covid-19 colocou decisivamente em evidência os problemas relacionados com a o controlo, organização e limitação dos tempos de trabalho dos teletrabalhadores. Se, por um lado, a flexibilidade horária e o potencial maior equilíbrio entre a vida pessoal e familiar dos trabalhadores figuram como principais vantagens do teletrabalho, um dos maiores problemas da sua utilização reside, justamente, na maior dificuldade em delimitar o tempo de trabalho e o tempo de descanso, diluindo-se as fronteiras entre a vida profissional e pessoal dos teletrabalhadores. Assim sendo, de que forma se poderão salvaguardar os limites temporais da jornada de teletrabalho? A presente dissertação pretende debruçar-se sobre as soluções que vêm sendo avançadas nos panoramas interno e internacional e apontar algumas alternativas de regulação para efetivação destes limites.
The massive adoption of telework as a means of preventing contagion by Covid-19 has decisively highlighted the problems related to the supervision, organization and limitation of teleworkers' work times. Whilst time flexibility and, potentially, a greater balance between personal and family life figures as the main advantage of teleworking, the reverse means that one of the biggest problems with its use lies in how difficult is the definition of work and rest time, blurring boundaries between the professional and personal life of teleworkers. Therefore, how can the time limits of the telework journey be safeguarded? This dissertation intends to look into the solutions that have been advanced in the domestic and international scenarios and point out some adjustment alternatives to implementing such limits.
