Abstract(s)
As práticas comerciais utilizadas pelos profissionais muitas vezes são consideradas enganosas ou agressivas, tornando-se desleais ao impedirem o consumidor de tomar decisões livres e esclarecidas. Têm em vista o poder económico, desconsiderando a parte mais fraca da relação de consumo – o consumidor. Para o proteger destas decisões que não teria tomado se não fosse sujeito a este tipo práticas, surgiu no âmbito do Direito Consumidor a Diretiva 25/2009/CE relativa às práticas comerciais desleais que visa a proteção do consumidor e o aperfeiçoamento do mercado interno. Esta é uma Diretiva de harmonização máxima que se destina a regular as relações entre profissionais e consumidores, limitando o seu âmbito às relações B2C. Neste trabalho vamos analisar a Diretiva de forma a questionar qual é realmente o seu âmbito.
Commercial practices used by professionals are often considered misleading or aggressive, becoming unfair by preventing the consumer to make free and informed decisions. They aim economic power, disregarding the weakest party in the consumer relationship - the consumer. To protect them from these decisions that they would not have taken if they were not subjected to this type of practices, the Directive 25/2009/EC on unfair commercial practices emerged in the context of Consumer Law, aiming to protect consumers and improve the internal market. This is a maximum harmonization Directive that is intended to regulate the relationship between professionals and consumers, limiting its scope to B2C relationships. In this paper we will analyze the Directive in order to question what its scope is actually.
