Abstract(s)
Constitui-se objeto de estudo da presente dissertação versar sobre um tema atual e polémico no âmbito do Direito Penal, a pornografia de menores. O presente estudo tem por objeto a criminalização deste fenómeno e as suas limitações. Far-se-á uma análise substantiva da pedopornografia e da pseudopedopornografia, a partir da sua evolução histórico-legislativa, do seu bem jurídico e das suas modalidades, analisando-se a doutrina e a jurisprudência relativas a determinadas vertentes problemáticas. Far-se-á também uma breve exposição acerca do conflito que a incriminação da pornografia com representação realista de menor poderá ter com outros direitos, nomeadamente a liberdade de expressão. Deste modo, pretende-se contribuir para um melhor enquadramento destas questões.
The following thesis debates a current and controversial theme in the scope of Criminal Law, child pornography. The object of this study it’s the criminalization of this phenomenon and its limitations. We will do a substantive analysis of the pedopornography and of the pseudopedopornography, from their historical-legislative evolution, juridical asset and modalities, analyzing the doctrine and jurisprudence about some controversial strands. We will also do a brief exposition about the conflict between the criminalization of the pseudopedopornography and other rights, namely the freedom of speech. Therefore, it is intended to contribute to a better understanding of this questions.
