Trata-se aqui da responsabilidade penal das pessoas coletivas pelos crimes de homicídio e ofensas corporais negligentes dos arts. 137.º e 148.º do Código Penal, que não se encontra prevista pelo artigo 11.º do mesmo Código, sendo certo que podem decorrer graves lesões destes bens jurídicos por parte de pessoas coletivas, designadamente a atuar na área da saúde. Discute-se também a possibilidade de
censurar diretamente a pessoa coletiva pelas deficiências apresentadas na sua estrutura e organização que se venham a repercutir negativamente nos mesmos bens jurídicos das pessoas ao seu cuidado.
The present dissertation will focus on the criminal liability of the legal persons for negligent homicide and physical injuries predicted by articles 137.º and 148.º of the Criminal Code, which is not included in the provision of article 11.º of the same Code although these values can easily be affected by the activity of corporations, namely in the health sector. It is also refereed the possibility of a direct censorship of the collective structure for its decisions and poor organization which lead to the violation of individual rights.
