O artigo 22.º do CIRE, que regula a responsabilidade pelo pedido infundado e pela
apresentação indevida à insolvência, é pouco claro e tem manifestas insuficiências
quanto ao âmbito de aplicação. Nesta dissertação, exploramos as diferentes posições
que, perante as graves consequências que um requerimento infundado levantaria,
pretenderiam ultrapassar estas limitações.
The Article 22.º of the CIRE, which regulates responsibility for an unfounded request or wrongful presentation for insolvency, is unclear and has obvious insufficiencies regarding its breadth of application.
