Na presente dissertação pretendemos abordar e enquadrar o trabalho desenvolvido em plataformas digitais, no ordenamento jurídico português. Mais concretamente, propomo-nos a analisar o caso dos estafetas, determinando se estes possuem um contrato de trabalho ou um contrato de prestação de serviços. Para tal, iremos examinar o regime constante da Diretiva aprovada relativa à melhoria das condições de trabalho nas plataformas digitais, bem como regime jurídico português nesta sede. A questão fulcral do presente trabalho será a discussão sobre a redação e eficácia da presunção de laboralidade redigida neste âmbito.
In this dissertation, we aim to address and contextualize work carried out through digital platforms within the Portuguese legal framework. More specifically, we intend to analyze the case of delivery couriers, determining whether they are bound by an employment contract or a service provision contract. To this end, we will examine the provisions of the recently approved Directive on improving working conditions in platform work, as well as the relevant Portuguese legal regime. The central issue of this study will be the discussion surrounding the wording and effectiveness of the presumption of employment established in this context.
