Existe um equilíbrio entre a nova Lei portuguesa sobre bodycams e direitos
fundamentais, como a privacidade e a liberdade? Esta é a questão à qual pretendemos responder no final da investigação presente nesta tese. Apesar dos muitos benefícios associados às câmaras corporais, a verdade é que, alguns obstáculos continuam a ser trazidos para discussão no que diz respeito a esta nova categoria de vigilância. As próximas páginas são o resultado de uma investigação que tem por base casos reais, legislação nacional e diferentes pontos de vista, enquanto forma de perceber se a concreta utilização das bodycams, e as últimas medidas adotadas para vigiar cidadãos e agentes responsáveis pela aplicação da lei, são de facto, providas de proporcionalidade.
Is there a balance between the new Portuguese bodycam law and fundamental rights, such as privacy and freedom? This is the question we aim to answer at the end of the investigation presented in this thesis. Regardless of the many benefits associated with body worn cameras, the truth is, some obstacles are still being brought to discussion when it comes to this modern category of surveillance. The next pages are the result of an investigation based on real-life cases, national legislation and different points of view, as a way to understand if the actual use of bodycams, and the latest measures adopted to watch citizens and law enforcement officers, are in fact are provided with proportionality.
