Abstract(s)
A presente dissertação tem como estudo o crime de abuso sexual de menores dependentes ou em situação de particular vulnerabilidade (art. 172º) e a sua distinção face ao crime de atos sexuais com adolescentes (art.173º). O início deste estudo passa pela evolução histórica dos tipos de crime mencionados, seguindo-se a análise do bem jurídico em causa. Contamos com uma avaliação aprofundada dos artigos 172º e 173º do Código Penal à luz da Lei nº40/2020, sendo que para enriquecer este estudo nos propusemos a analisar alguma jurisprudência. Por último, confrontámos as alíneas b) e c) do artigo 172º com o artigo 173º para percebermos se fará sentido manter o tipo legal de crimes relativo aos atos sexuais com adolescentes.
This dissertation studies the crime of sexual abuse of dependent minors or those in a situation of particular vulnerability (art.172) and its distinction from the crime of sexual acts with adolescents (art.173). The beginning of this study goes through the historical evolution of the types of crime mentioned, followed by an analysis of the legal asset in question. We have carried out an in-depth assessment of articles 172 and 173 of the Penal Code in the light of Law 40/2020, and to enrich this study we proposed the analysis of jurisprudence. Finally, we compared article 172 (b) and (c) with article 173 in order to reach an understanding regarding the maintenance of the article on sexual acts with adolescents.
