Abstract(s)
A presente dissertação tem como objetivo a análise crítica da pena acessória de
inibição do exercício das responsabilidades parentais no âmbito do crime de violência
doméstica, prevista no número 6 do artigo 152º do Código Penal.
Verificaremos que, noutros âmbitos a referida inibição assume contornos bastante
distintos. Por um lado, é marcada por uma maior e incompreensível rigidez de regime
face à sua previsão nos crimes sexuais e por outro, pela incontornável manutenção, sem
fundamento, da situação de inibição em contraposição com a flexibilidade apresentada
no direito civil e em violação da lei constitucional.
Julgamos ser essencial uma intervenção legislativa para que se alcance um respeito
efetivo dos direitos dos progenitores enquanto tais e se assegure que o resultado das
decisões judiciais penais sempre coincidirá com o superior interesse da criança.
This dissertation aims to a critical analysis of the accessory penalty of inhibition of the parental responsibilities exercise in the scope of domestic violence crime, foreseen in number 6 of article 152º of the Criminal Code. We verified that in other scopes, this inhibition assumes several different contours. On the one hand, it is marked by a high and incomprehensible rigidity regime compared to its prediction in sex crimes, on the other hand, by its unavoidable maintenance without foundation of the inhibition state as opposed to the flexibility presented in civil law and in violation of constitutional law. We strongly believe that a legislative intervention is essential to achieve effective respect for the rights of parents as such, and ensure that the results of the criminal judicial decisions will always coincide with the best interests of the child.
