O presente estudo tem como principal propósito a análise e reflexão acerca da
desfiguração grave e permanente prevista no crime de ofensas à integridade física graves
(artigo 144º do Código Penal). Assim, analisaremos, previamente, os diferentes tipos
legais de crime respeitantes às ofensas à integridade física previstos no nosso Código
Penal, bem como o bem jurídico por eles tutelado.
Julgamos ser importante refletir sobre a forma como a desfiguração grave e
permanente tem vindo a ser encarada no nosso ordenamento jurídico e questionarmos se
será essa a melhor forma, comparando com outros ordenamentos jurídicos,
designadamente o espanhol, italiano e alemão.
The presente study´s main objectivo is to analyse and reflect upon the severe and permanent disfiguration described in the crime of serious offences against a person´s physical integrity (article 144 of the Portuguese Penal Code). Therefore, we firstly analyse the different legal types of crimes regarding offences against a person´s physical integrity in our Penal Code, as well as the legal good that is protected. We believe it is importante to reflect on how the severe and permanent disfiguration has been faced in our legal framework and question if it is the best possible way, by comparing with other legal frameworks, namely the Spanish, Italian and German frameworks.
