Abstract(s)
A presente dissertação compreende como tema principal a relevância dos
direitos económicos, sociais e culturais, bem como a sua interligação com os direitos de
liberdade e garantias e o seu respetivo enquadramento na sociedade.
Fazemos uma análise ao Estado social, porquanto do seu desenvolvimento ser
uma condição essencial para a existência dos direitos sociais. Investigamos, ainda, tanto
as semelhanças, como as destrinças entre os então mencionados direitos quanto ao seu
regime diferenciado, à luz da Constituição da República Portuguesa de 1976.
Para além do mais, procuramos encontrar respostas à questão de saber qual é, de
facto, a discricionariedade que os Estados têm quanto à implementação e efetivação dos
direitos sociais. Para este efeito, recorremos a várias teorias, entre elas sociais, políticas
e culturais.
É realizada uma abordagem da legislação interna portuguesa, como também do
Direito internacional, dando especial relevância à Declaração Universal dos Direitos
Humanos. Complementaremos com a intrínseca ligação dos direitos sociais enquanto
direitos humanos, salientando a interligação do direito à saúde com o direito à vida com
dignidade.
Finalizaremos com uma comparação entre o constitucionalismo e a
implementação dos direitos sociais nos Estados Unidos da América e em Portugal.
The following master thesis comprehends as the main subject the relevance of economic, social and cultural rights, as well as its interconnection with rights, liberties and freedoms and its respective framework in society. We make an analysis to the welfare state, for its development is considered as an essential condition to the existence of social rights. We will further investigate not only its similarities, as well as its dissimilarities between the above-mentioned rights regarding its different regime in the light of the 1976 Portuguese Constitution. Henceforth, we seek to find answers to the question of what the states discretion regarding social rights implementation and realization are. In fact, we resort to various theories, among them social, political and cultural. An approach is made to our country’s current national law, as well as international law, giving special relevance to the Universal Declaration of Human Rights, as well as to the interconnection of social rights as human rights, giving emphasis to the connection between the right to health and the right to life with dignity. Ultimately, we will compare the constitutionalism and implementation of social rights between the United States of America and Portugal.
