Abstract(s)
O cenário laboral é um campo propício à ocorrência de vários tipos de discriminação. Concretamente, vemos que o sexo continua a ser um dos fatores na base de grande parte dos casos de desigualdade. A maioria destes casos corporiza situações de discriminação indireta, resultando da aplicação de critérios aparentemente neutros que produzem resultados análogos, mas que, na realidade, afetam desproporcionalmente membros de um determinado grupo, neste caso, as mulheres. Assim, a presente dissertação propõe uma análise sobre o conceito de discriminação indireta, debruçando-se em diversos casos ilustrativos deste fenómeno e problematizando questões de diferentes índoles, tendo sempre por base doutrina e jurisprudência pertinente, de forma a contribuir para o seu estudo prático.

To this day, most discrimination reports are gender based and we know that the vast majority of these happen through indirect discrimination as a result of the existence of seemingly neutral criteria that, in practical terms, disproportionally affects one group more than the other - in this case, women. With this in mind and wanting to contribute to its practical study, taking guidance from doctrine and case law, this dissertation aims to study the concept of indirect discrimination using several examples that will help shed light and raise important questions on the subject.
