No presente estudo propomo-nos a analisar o enquadramento dos prestadores em plataformas digitais, no âmbito do ordenamento jurídico laboral português, começando por abordar o fenómeno da economia on-demand, o conceito de trabalhador à luz do ordenamento jurídico português e do direito da união europeia. Por fim, analisaremos decisões de instâncias internacionais e comparadas e tentaremos apresentar uma solução para problema apresentado.
On this essay, we intend to analyse the legal framework of digital platform service providers within Portuguese labour law. To this effect, we address the on-demand economy phenomenon and the concept of employee within the Portuguese legal system and within the scope of European Union law. Finally, we take into account decisions from foreign and international bodies in order to try and present a solution to this problem.
